RELEASE AND WAIVER OF LIABILITY AGREEMENT I, _____________________________________________ (“Participant”), acknowledge that I have voluntarily applied to participate in the following activities at The Choctaw Round Up Club (the “Arena”) and will not hold The Choctaw Round Up Club (“Lessor”) responsible for any injuries or death. I AM AWARE THAT THESE ACTIVITIES ARE HAZARDOUS ACTIVITIES AND THAT I COULD BE SERIOUSLY INJURED OR EVEN KILLED. I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED, AND AGREE TO ASSUME ANY AND ALL RISKS OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE, OR THEFT, WHETHER THOSE RISKS ARE KNOWN OR UNKNOWN. As consideration for being permitted by the Arena, the State of Oklahoma (“State”), the County of Oklahoma County (the “County”), and any lessor of the Arena premises (“Lessor”), to participate in these activities and use the Arena premises and facilities, I forever release the Arena, the State, the County, the Lessor, any Arena affiliated organization, and their respective directors, officers, employees, volunteers, agents, contractors, and representatives (collectively “Releases”) from any and all actions, claims, or demands that I, my assignees, heirs, distributes, guardians, next of kin, spouse and legal representatives now have, or may have in the future, for injury, death, or property damage, related to (i) my participation in these activities, (ii) the negligence or other acts, whether directly connected to these activities or not, and however caused, by any Release, or (iii) the condition of the premises where these activities occur, whether or not I am then participating in the activities. I also agree that I, my assignees, heirs, distributes, guardians, next of kin, spouse and legal representatives will not make a claim against, sue, or attach the property of any Release in connection with any of the matters covered by the foregoing release. OKLAHOMA – Except as provided in subsection B of Section 50.3 of Title 76, a livestock activity sponsor, a participant or a livestock professional acting in good faith and pursuant to the standards of the livestock industry shall not be liable for injuries to any person engaged in livestock activities when such injuries result from the inherent risk of livestock activities. Oklahoma Statutes as Section 50.3 of Title 76. I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND THE ARENA, THE STATE, THE COUNTY, AND THE LESSOR, AND SIGN IT OF MY OWN FREE WILL. If Signed by Parent or Guardian: I verify that the dangers of the activities and the significance of this Release and Waiver were explained to the Participant and that the Participant understood them.

I agree to the Rodeo Ticket Waiver

I, the undersigned member (and my parent or guardian if I am younger than 18 years of age), intending to be legally bound, do hereby forever release and waive any and all rights, claims, and actions for damages that we, our heirs, executors, administrators, and assigns may have, or that may hereafter accrue against any and all persons, organizations, and other entities associated with the organization, including, but not limited to Rodeo Ticket, sponsors, affiliates, volunteers, Choctaw Round Up Club Memberships Management, arising out of or in connection with my involvement before, during, or after the association membership.

I verify that I am physically fit and sufficiently capable to participate in this membership and I assume the risks involved in this active membership. I further attest that I will be mindful of risks related to membership, and hold said sponsors and organizers blameless in any harm that may happen.

I consent to the collection and use of my Personal Information as contained in the Privacy Policy. I also give my permission for the free use of my name and/or pictures in telecasts, broadcasts, newspapers, posters, advertising, etc.

I also acknowledge understanding that the charge to my card will show up as Rodeo Ticket. I acknowledge that the online processing fees and charitable donations are non-refundable. I also acknowledge that any charitable donations will have 4.97% withheld from the donation to pay credit card and administrative costs.

Rodeo Ticket shall not be liable to me for any direct, indirect, special, incidental, consequential or exemplary damages including, but not limited to, loss of profits, goodwill, use, data or other intangible loses. Rodeo Ticket does not guarantee the completeness or accuracy of any information contained in, or provided in conjunction with the http://www.rodeoticket.com website. Rodeo Ticket is not responsible for any omissions or inaccuracies, or for the results obtained from this information.

Rodeo Ticket facilitates registration for various events, some of which allow memberships under the age of thirteen (13). We require a submission of birth date for all membership entries. For children under the age of thirteen (13), parental or guardian consent is required.

I agree that the statutes and laws of the State of Utah, USA, will apply to all matters relating to this Agreement and Waiver. I irrevocably consent that exclusive jurisdiction for any dispute with Rodeo Ticket relating to this Agreement and Waiver resides in the courts of Utah, and I further agree and expressly consent to the exercise of personal jurisdiction in the courts of Utah in conjunction with any such dispute including any claim involving Rodeo Ticket.
